Terms of Service

By accessing and using OxyRemote ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App. These Terms apply to all users of the App, including account holders, viewers, and visitors to our website.

OxyRemote is a mobile application that connects to Bluetooth pulse oximeters to provide real-time and remote health monitoring of blood oxygen saturation (SpO₂) and heart rate. The App allows users to share device data with authorised remote viewers. The App requires compatible Bluetooth pulse oximeter hardware, which is not provided by OxyRemote. The App is available on iOS and requires a compatible iPhone.

To use certain features of the App, you must create an account with a valid email address. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate and complete information during registration and to update your information to keep it accurate and current.

You agree to: • Use the App only for lawful purposes and in accordance with these Terms • Not attempt to reverse-engineer, decompile, or disassemble any part of the App • Not use the App to transmit any harmful or malicious code • Not share your account credentials with unauthorised individuals • Accept full responsibility for any data you choose to share with remote viewers You acknowledge that you are responsible for the oximeter hardware you connect and for ensuring it is used in accordance with its manufacturer's instructions.

OxyRemote offers subscription plans to unlock premium features such as device sharing and extended history. All subscriptions are processed through Apple's App Store and are subject to Apple's payment terms. • Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current period • You can manage and cancel subscriptions in your iOS Settings → Apple ID → Subscriptions • No refunds will be provided for unused portions of a subscription period • We reserve the right to modify subscription pricing with advance notice

All content, features, and functionality of the App — including but not limited to the design, text, graphics, logos, icons, and software — are the exclusive property of OxyRemote and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any part of the App without our prior written consent.

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, OXYREMOTE DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components. We do not guarantee the accuracy, completeness, or reliability of any data displayed in the App.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OXYREMOTE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE APP. In no event shall our total liability to you for all claims arising from the use of the App exceed the amount you paid us in the twelve (12) months preceding the claim, or one hundred US dollars (USD $100), whichever is greater.

OxyRemote is not a medical device and is not intended to diagnose, treat, cure, or prevent any disease or medical condition. The data displayed by the App is for informational purposes only and should not be used as a substitute for professional medical advice, diagnosis, or treatment. Always consult a qualified healthcare professional regarding any medical concerns. If you believe you or someone you are monitoring is experiencing a medical emergency, call emergency services immediately. OxyRemote does not provide medical advice and is not responsible for any health decisions made based on data displayed in the App.

We reserve the right to suspend or terminate your account at any time, with or without cause, including if we reasonably believe you have violated these Terms. Upon termination, your right to use the App will immediately cease. You may terminate your account at any time by contacting us at support@oxyremote.com. Upon verified deletion, your data will be removed from our live databases within 30 days.

We may update these Terms from time to time. We will notify you of material changes via an in-app notice or email at least 14 days before they take effect. Continued use of the App after the effective date constitutes acceptance of the revised Terms.

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or the use of the App shall be resolved in the courts of competent jurisdiction.
